Acceptable Use Policy

This Acceptable Use Policy ("AUP") defines acceptable practices for the use of the services (the "Services") provided by FND Engineering LLC ("FND Engineering", "we", "us", or "our"). By using the Services, you acknowledge that you and your users are responsible for compliance with this AUP. You agree to be bound by this AUP and to be responsible for any violation of this AUP by your users, customers, or anyone who accesses our Services through your account.
We reserve the right to modify this Policy at any time, effective upon posting of the modified Policy to this URL. We will make reasonable efforts to notify you of significant changes, but your continued use of the Services constitutes acceptance of those modifications.
1. No Spam or Unsolicited Commercial Email (UCE)
FND Engineering operates strictly as a transactional data alert and API infrastructure provider. We maintain a zero-tolerance policy against the sending of unsolicited bulk email, spam, or any other form of UCE. Our platform is engineered for high-deliverability transactional alerts generated by our internal parsing engines or through explicit API triggers initiated by authenticated users.
- Strict Opt-In Requirement: Any emails sent using our API infrastructure must be directed only to recipients who have explicitly opted in to receive communications from you. Purchased, rented, or third-party appended email lists are strictly prohibited.
- Clear Opt-Out: All commercial and alert-based emails must contain a clear, conspicuous, and fully functional unsubscribe mechanism. You must process unsubscribe requests within 24 hours.
- Sender Identification: The "From" address must accurately identify the sender, and the "Subject" line must not be deceptive or misleading regarding the content of the message.
2. Prohibited Content and Activities
You may not use the FND Engineering Services to transmit, distribute, store, or process any material or data that is unlawful, harmful, or generally unacceptable to the internet community. Prohibited activities include, but are not limited to:
- Malicious Code: Distributing viruses, worms, Trojan horses, ransomware, spyware, or any other malicious code designed to disrupt, damage, or gain unauthorized access to any system, network, or data.
- Phishing and Fraud: Engaging in phishing scams, social engineering, financial fraud, pyramid schemes, or attempting to falsely obtain sensitive personal or financial information.
- Intellectual Property Infringement: Transmitting or hosting material that infringes on the copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any third party.
- Illegal Content: Promoting illegal drugs, illegal weapons, child exploitation materials, terrorism, or any activity that violates local, state, national, or international laws.
- Harassment and Abuse: Sending threats, inciting violence, or disseminating hate speech targeting protected groups or individuals.
3. API Abuse and Platform Integrity
Our platform relies on the stability and performance of our infrastructure to deliver sub-second latency for industrial asset alerts. Users are strictly prohibited from abusing the API or attempting to bypass platform limitations.
- Rate Limiting: You must respect all rate limits imposed on your account tier. Attempting to circumvent these limits through multiple accounts, IP rotation, or other obfuscation techniques is grounds for immediate termination.
- Reverse Engineering: Decompiling, reverse engineering, or attempting to discover the source code or proprietary parsing algorithms used by FND Engineering is strictly forbidden.
- Penetration Testing: Unauthorized security scanning, penetration testing, or load testing of our infrastructure without prior written consent from our security team is prohibited.
4. Reputation and Deliverability Metrics
To protect the reputation of our shared IP pools and the deliverability of alerts for all clients, we actively monitor sending metrics. Accounts exceeding acceptable industry thresholds may face immediate suspension or throttling.
- Hard Bounces: You must maintain a hard bounce rate of less than 3%. Repeatedly sending emails to invalid or non-existent addresses will trigger automated account reviews.
- Spam Complaints: Your spam complaint rate must remain below 0.1% (one complaint per 1,000 messages). High complaint rates indicate a violation of our opt-in policies and will result in mitigation actions.
- Spam Traps: Hitting known spam traps (honeypots) indicates poor list hygiene or the use of scraped data. We reserve the right to suspend accounts that repeatedly trigger spam trap alerts across major ISPs.
5. Enforcement and Actions
FND Engineering retains the absolute right, but not the obligation, to monitor your usage of the Services to ensure compliance with this AUP. If we determine, in our sole discretion, that you have violated any provision of this policy, we may take any of the following actions without prior notice:
- Issue a formal warning and require immediate corrective action.
- Temporarily throttle your API requests or email sending limits.
- Suspend your access to specific features or the entire Service.
- Permanently terminate your account and forfeit any unused prepaid balance.
- Cooperate fully with law enforcement authorities or third-party investigators regarding any illegal activities or suspected fraud.
6. Reporting Violations
We encourage anyone who believes that a violation of this AUP has occurred to report the incident to our abuse team immediately. When reporting, please provide full email headers, logs, or other relevant evidence to facilitate our investigation.
